Just because an officer conducts field sobriety testing, gives you a “breath test”, and arrests you for DWI/DUI does not necessarily mean you were in fact DWI/DUI!

There are many factors such as fatigue, injuries, medications, dental work, age, weight, illness, and disease that can give the false impression of DWI/DUI.  The prosecutor must prove the criminal portion of your case “beyond a reasonable doubt”.  Beyond a reasonable doubt is the highest burden of proof in a criminal case and officers must comply with many laws and regulations when performing Standardized Field Sobriety Testing (SFST), Breathalyzer testing, Miranda Warnings, Blood Testing, Implied Consent laws, etc.
